Terms of Service

These Terms of Service ("Terms") govern your access to and use of Gelato ("Service"), operated by Gelato ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Gelato is a grocery spending tracker that allows users to scan receipts, track budgets, analyse spending patterns, and share household expenses. The Service is provided as a subscription-based software product accessible via web browser and mobile application.

2. Eligibility

You must be at least 16 years old to use Gelato. By using the Service, you represent that you meet this requirement. If you are using Gelato on behalf of a household or other group, you represent that you have the authority to agree to these Terms on their behalf.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@gelato.app if you suspect unauthorised access to your account.

You agree to provide accurate and complete information when registering and to keep your account information up to date. We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. Subscription and Payment

4.1 Free Trial

New accounts receive a 7-day free trial of Gelato Pro. No charge is made during the trial period. You may cancel at any time before the trial ends to avoid being charged.

4.2 Paid Subscription

After the trial period, continued use of the Service requires a paid subscription at $9.99 USD per month. Your subscription renews automatically on a monthly basis until cancelled.

4.3 Billing

Payments are processed by Stripe (web) or via Apple App Store / Google Play (mobile). By subscribing, you authorise us to charge your chosen payment method on a recurring monthly basis. All prices are in USD and inclusive of applicable taxes where required by law.

4.4 Cancellation

You may cancel your subscription at any time via the Billing page in the web app or through your Apple / Google account settings on mobile. Cancellation takes effect at the end of your current billing period — you retain access to the Service until then. No partial refunds are issued for unused time in a billing period.

4.5 Refunds

All payments are non-refundable except where required by applicable law. If you believe you have been charged in error, contact us at support@gelato.app within 14 days of the charge.

4.6 Price Changes

We reserve the right to change our subscription price. We will give you at least 30 days' notice of any price increase via email. Your continued use of the Service after the new price takes effect constitutes acceptance of the new price.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Upload content you do not have the right to upload, including copyrighted material or another person's personal data without their consent.
  • Attempt to gain unauthorised access to the Service, its servers, or any connected systems.
  • Use automated scripts, bots, or crawlers to access or scrape the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Resell, sublicense, or commercially exploit the Service without our prior written consent.
  • Reverse-engineer, decompile, or attempt to extract source code from the Service.

6. Your Content

You retain ownership of all content you upload to Gelato, including receipt images and spending data ("Your Content"). By uploading content, you grant us a limited, worldwide, royalty-free licence to store, process, and display Your Content solely for the purpose of providing the Service to you.

You are responsible for ensuring that Your Content does not infringe the rights of any third party. We do not claim ownership of Your Content and will not use it for advertising or share it with third parties except as described in our Privacy Policy.

7. Intellectual Property

The Service, including its software, design, trademarks, and all content we create, is owned by Gelato and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited right to use the Service as described herein.

8. Third-Party Services

The Service integrates with third-party services including Supabase, OpenAI, Stripe, and RevenueCat. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.

In particular, receipt images are processed by OpenAI to extract text. By uploading a receipt, you consent to that image being transmitted to OpenAI's API for processing.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Spending data and analytics produced by the Service are for informational purposes only and should not be relied upon as financial advice.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Gelato and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or relating to your use of the Service.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Gelato and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may terminate your account at any time by contacting us at support@gelato.app or through the account settings in the app.

Upon termination, your right to use the Service ceases immediately. We will handle your data as described in our Privacy Policy. Sections 6, 7, 9, 10, 11, and 13 survive termination.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Gelato operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
